Definition: Terms of Use are conditions the user accepts and abides by. (“Agreement”). So in English, …the Terms and conditions refer to an agreement between you and us.

Hey, just so you know, this Agreement was updated on, and is effective as of 1st January 2015.

This website, the “SITE” is solely owned and operated by Educator’s Depot, Inc. (“We”, “Us”, the “Company” or “Educator’s Depot”) for our registered User/Member (that would be you). Use of the “SITE” establishes that you, the “USER” agrees to these terms and conditions. Please stop all usage of our website if you do not agree to these terms or conditions; (“Agreement”).

Educator’s Depot reserves the right, at any time, to modify, alter, or update the terms and conditions of this Agreement without prior notice. Modifications shall become effective immediately upon being posted on the “SITE”. Your continued use of the “SITE” constitutes acceptance of all modifications made to the “SITE”.

Service
We will do our best to provide you with a venue from which you may purchase goods (furniture and equipment) and services at really great prices. We really are trying hard!!

Where
We intend this site to be used principally within the United States, Canada and Mexico. But be aware that we would, under the right circumstance, take an order from anywhere in this Universe. We make no representation that such services are appropriate or available for use in other locations. Those who choose to access this Site from locations other than the United States do so on their own initiative and are responsible for compliance with local laws if and to the extent local U.S. laws are applicable….Yes, even on Mars!

Disclaimer of Warranties and Limitation of Liability
Note well that we are not liable for any damages or losses you incur from the use of our site, goods or services. All products sold are done so with the offering of a manufacturer’s warranty alone. No further claims may be made directly against Educator’s Depot, Inc. as we sell said goods to you in the original manufacturing “as is” state as expressly implied under applicable law. They are new products with manufacturer’s warranties but we do not offer additional or extended warranties on their manufactured products sold. As such, Educator’s Depot, Inc., its licensors, officers, employees, agents, members, affiliates, owners, and contractors disclaim any and all warranties, express or implied, disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. So we extend to you the usual manufacturer’s warranty but are prevented from offering any extensions to them; dig it?

Without limiting the foregoing, we do not warrant that the functions contained on the site will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available is free of viruses or other potentially harmful components. You will even note at the bottom of our home page our Site lock Seal which REALLY makes us safe from the “bad guys”.

We do our best to make this website accurate however, even we sometimes make mistakes, so we make no representations regarding the use or the results of the use of the materials on the site in terms of their correctness, accuracy, reliability, or otherwise.

We are very reasonable people and will do our very best to work with you to resolve any concerns you may have but understand that otherwise this agreement defines your sole and exclusive remedy. We look forward to collaborating with you so that you are pleased with us.

Changes and Continuity of Service
From time to time we must modify or even temporarily shut down the site to perform routine repair, corrections and adjustments. Actually, it’s best that we do so you have the best and latest information available to you. Educator’s Depot, Inc. reserves the right to modify or even discontinue the “SITE” or any part thereof with or without notice to the Member. We shall not be liable to Member or any third party should we exercise our right to modify or even discontinue the Site. We do not and cannot guarantee uninterrupted and secure access to our “SITE” as it may be subject to a great deal of external factors beyond our control affecting performance. We promise to do our very best not to inconvenience you.

Members’ Account

Each member to this site will receive a dedicated and secure account to be accessed with dedicated usernames and passwords. Even our staff can’t see your credentials. We can only assist you in resetting your credentials. Psst…we thought it best if they remained TOP SECRET. Each member is solely responsible for any and all activity which occurs under their account whether authorized or not authorized. You agree to notify us of any unauthorized use of member’s account or any other breach of security known or which should be known you. You must not share, disclose, or disseminate the confidential and unique secure password credentials. You agree that all depictions and representations inclusive of data, specifications and images is the sole property of Educator’s Depot, Inc. and may not be copied, resold or made use for commercial purposes without our express written consent.

Intellectual Property and Privacy(see our official Privacy Policy/Statement below-without a sense of humor!!)
Any data or content that you add to our “SITE” belongs to you and will NOT be shared unless mandated or required by due process of law. WE WILL NEVER SHARE YOUR INFORMATION UNLESS IT IS WITH A FINANCIAL/SECURITY INSTITUTION TO PROCESS YOUR REQUESTS. We are paranoid about privacy so this is a pretty simple concept to understand. You own all of the information you post on the “SITE”, and you can control how it is shared through your privacy settings. We own all of the content and information that we post to the site, including without limitation all trademarks and copyrights for materials and text we post to the Site. Nice relationship, don’t you think?

We also reserve the right, in our sole discretion, to terminate your access and kick your cyber-butt out of all or part of any of the Site, for any reason, with or without notice. So be nice!

Governing Jurisdiction of the Courts in the Great State OF Texas
This Agreement is governed by and will be construed according to Texas law, excluding any principles of conflicts of law. In the event of any dispute or controversy arising from this Site, you consent to the jurisdiction of the courts of Fort Bend County, Texas and of the federal district court of South East Texas. You further agree that venue for litigation arising from this Site will be exclusively in the Southern District of Texas or its counterpart state court.

Entire Agreement
